Initial media reports of the attack claimed the attackers shouted “MAGA country” during their attack, but ABC 7 Chicago reporter Rob Elgas noted that Chicago Police PIO informed him that Smollett never claimed those words were uttered in their initial report.

The Chicago Police PIO told him, “I’m not saying it’s not true. He could have remembered later, but he did not tell officers that in the initial report.”

Elgas would also report that in a follow-up interview, Smollett did indeed claim that his attackers yelled “MAGA country” at him.

By February 2019, the Chicago Police’s investigation claimed that Smollett had staged the attack with brothers Obabinjo Osundairo and Abimbola Osundairo.

The brothers claimed that Smollett paid them $3500 to stage the attack and that the rope and bleach used to attack Smollett was bought at the Crafty Beaver Hardware Store in Ravenswood at the direction of Smollett. A red hat was also allegedly purchased at a local beauty supply store.

The two brothers even said the attack was rehearsed before its occurrence on January 29th.

Smollett would be arrested on February 21st and charged with a felony disorderly conduct charge for filing a false report. The bond proffer would go on to outline the timeline of the events and how Smollett masterminded the hoax hate crime.

By March 2019, Smollett would be charged with 16 felony by a Cook County grand jury with the grand jury noting that Smollett lied to police on two different occasions about the alleged hate crime. The first was to the beat cop who took the initial report and the second was in a follow-up interview conducted the same day by a detective.
